THE GEAR SPA - TERMS & CONDITIONS

These Terms & Conditions govern the provision of services by The Gear Spa (“we”, “us”, “our”). By placing an order, you (“the Customer”) agree to be bound by these terms.

1. Services

1.1 We provide specialist cleaning, deodorising, reproofing and restoration services for clothing, equipment and related items.

1.2 Services are carried out with reasonable care and skill in accordance with UK consumer law.

1.3 All services are maintenance and restoration services only. We do not provide repair, alteration or structural refurbishment unless expressly agreed in writing.

2. Customer Declarations & Item Condition

2.1 The Customer warrants that all information provided regarding the item(s), including photographs and condition details, is accurate and complete.

2.2 The Customer must disclose any known damage, wear, delamination, weakened fabrics, dry rot, mould, prior repairs, or structural issues prior to processing.

2.3 We reserve the right to refuse service for any item deemed unsuitable, excessively damaged, contaminated, unsafe or beyond reasonable restoration.

2.4 Cleaning may expose pre-existing weaknesses, including but not limited to seam failure, coating breakdown, membrane separation, dye instability or material fatigue. We are not liable for deterioration arising from pre-existing conditions.

3. Performance & Outcome Limitations

3.1 While we use specialist processes designed for technical fabrics and materials, we do not guarantee:

  • Complete stain removal

  • Full odour elimination in severe cases

  • Restoration of waterproofing where membranes or coatings are structurally degraded

  • Full restoration of insulation where fill integrity or baffle construction is compromised

3.2 Re-lofting of down products is dependent on the structural condition of the garment and internal compartments.

3.3 Sterilise & Deodorise treatment provides sanitisation and deodorisation only and does not repair physical or structural damage.

4. Shipping to The Gear Spa

4.1 The Customer is responsible for arranging and paying for delivery of item(s) to us.

4.2 We strongly recommend using a tracked and insured service.

4.3 Risk in the item remains with the Customer until the item is received and signed for by us.

5. Turnaround Times

5.1 Standard service turnaround is up to 14 days from confirmed receipt of the item.

5.2 Express service (if purchased) is up to 7 days from confirmed receipt.

5.3 Turnaround times are estimates only and may vary during peak periods or where additional assessment is required.

6. Return Delivery

6.1 Return shipping is included for standard UK orders unless otherwise stated.

6.2 Risk transfers back to the Customer upon dispatch of the item from our premises.

7. Liability

7.1 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.

7.2 Subject to clause 7.1, our total liability for any claim arising out of or in connection with the services shall be limited to:

  • The cost of the service provided; or

  • The fair market value of the item at the time of service, taking into account age, condition and depreciation,
    whichever is lower.

7.3 We are not liable for:

  • Consequential or indirect losses

  • Loss of use

  • Loss of business or opportunity

  • Deterioration caused by pre-existing wear or material breakdown

  • Manufacturer defects or product design limitations

7.4 We do not accept liability for colour loss, shrinkage, seam stress or coating changes where these arise from age, material instability or manufacturer treatment processes.

8. Cancellations & Refunds

8.1 Orders may be cancelled prior to processing.

8.2 Once cleaning or treatment has commenced, services are non-refundable.

8.3 If an item is deemed unsuitable prior to processing, a refund will be issued excluding any applicable shipping costs.

9. Abandoned Items

9.1 Items not paid for or not claimed within 60 days of notification may be disposed of at our discretion.

10. Governing Law

These Terms & Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Insurance & Valuation

11.1 Customers are responsible for insuring items for transit to The Gear Spa at their own discretion.

11.2 We maintain appropriate business insurance; however, our liability remains subject to the limitations set out in Clause 7.

11.3 Compensation for any accepted claim shall not exceed the item’s current fair market value, taking into account age, condition, prior wear and depreciation. Not the original retail price.

11.4 Where an item is of particularly high value (including but not limited to race leathers, specialist protective equipment, expedition tents or premium technical outerwear), the Customer must notify us in writing prior to dispatch if the item has a replacement value exceeding £1,000.

11.5 We reserve the right to decline service for items exceeding our insurance coverage limits unless agreed in writing prior to receipt.

11.6 Proof of purchase, age and condition may be required in the event of a claim.
